This document (General Conditions of Sale) defines the conditions applicable to sales concluded between on the one hand people making a purchase on the site https://www.papillonmode.com, hereinafter referred to as "the customer" and on the other hand Fashionenza SERFOX, manager whose head office is located at 198, Avenue Henry Clews Résidence du Golf Mandelieu la Napoule 06210, registered with the Cannes RCS under number 877 499 459, hereinafter referred to as “Fashionenza”.

These general conditions of sale are subject to French law.

www.papillonmode.com reserves the right to modify the general conditions of sale and update them without notice. The customer must, for each order placed on the site www.papillonmode.com, confirm his acceptance of these general conditions of sale in force on the date of placing his order.

1. PRICE

The prices of items sold on our sites are indicated in euros, all taxes included, excluding shipping costs.

www.papillonmode.com reserves the right to modify its prices at any time and without notice. Items will be invoiced based on the rates in effect at the time the orders are placed. They remain the property of www.papillonmode.com until full collection of the price of the order by www.papillonmode.com. This price is payable in full and in a single payment.

2. ORDER

www.papillonmode.com reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order or who presents any form of risk in its eyes.

Any order constitutes acceptance of the prices and descriptions of the products available for sale. Photographs illustrating the products do not fall within the contractual scope. It is possible that non-essential errors appear on the site, which the customer accepts and acknowledges. Under no circumstances can www.papillonmode.com be held liable. Www.papillonmode undertakes to honor orders received on the website only within the limits of available product stocks. 3. SHIPPING, DELIVERY

All orders placed on www.papillonmode.com are processed within 24 hours from Monday to Friday (excluding public holidays) subject to payment validation. Orders placed on weekends and public holidays are processed the next business day.

In exceptional periods (private sales, festivals, public holidays, etc.) the delivery time may vary up to

72 hours maximum except in cases of force majeure or insurmountable force linked to a third party to the contract.

The customer is solely responsible for choosing the delivery method, as well as the accuracy of the delivery information transmitted when ordering. Therefore www.papillonmode.com cannot be held responsible for errors made by the customer in the wording of the contact details of the recipient of the order.

The customer is informed that in the event of non-delivery of the package or theft during transport, and cannot request compensation in any form whatsoever and www.papillonmode.com cannot be held responsible.

For all delivery methods, the tracking information provided by the carrier is authentic and binding on the customer and www.papillonmode.com.

The products ordered are transported at the sole risk of the customer.

Delivery :

The packages are delivered in France, by Mondial Relay followed at the price of

€5, within 3-5 days at a relay point and at home in France by Colissimo post followed at the price of €9, within 2-3 days.

A delivery estimate is given to you before placing your order also for all other destinations in Europe.


Any delays in delivery attributable to the carrier or to www.papillonmode.com do not entitle the customer to claim compensation.

All packages are carefully prepared by the www.papillonmode.com team. The condition of the packaging is scrupulously checked by us before shipping. However, the customer is required to check the condition of the delivered packages and to refuse them if they are damaged.

The customer is required to check the conformity of the products received in execution of his order at the time of delivery.

Any apparent anomaly regarding delivery such as:

- damaged package,

- Missing products,

- Deteriorated products,

- Products not in conformity with the order,

must be notified by the customer or recipient with any reservations to the carrier at the time of delivery andwithin the legal deadlines following receipt of the order and communicated to www.papillonmode.com either:

4. PAYMENT

Payment for orders on www.papillonmode.com is made by:

-Bank cards (CB, Visa, Master Card)

-PayPal.

www.papillonmode.com does not accept payments by check. All checks sent to us by mail will be automatically refused and destroyed.

5. SECURITY OF TRANSACTIONS

The 3D Secure system, created since 2001 by the international issuers VISA and MASTERCARD, aims to strengthen the security of online payments.

6. EXCHANGE, RETURN AND REFUND

The customer has fourteen days from receipt of his order to withdraw from this contract.

Procedure

Returns/Refunds:

0. Fill out the Return Form form and send it to us in one click.

1. Collect the validated return slip in your mailbox.

2. Print the validated return slip and slip it inside your package with a copy of your purchase invoice. Pack the item(s) to be returned following the instructions below. Print the return sticker and stick it on the package.

3. Drop off the package at your postal point.

Return conditions for refund or exchange


www.papillonmode.com undertakes to reimburse the customer for the amount of the items returned for reimbursement within a legal period of 14 days following receipt of the package on its premises, subject to compliance with the conditions below

All items must be returned intact as sent to you.

www.papillonmode.com reserves the right to refuse any request for exchange or refund if the items have been visibly worn.

Please note: shoe boxes should not be used directly for shipping, they must be packaged.

Packages returned postage due will be systematically refused.

Repayment Terms :

The customer can request the following 3 reimbursement methods:

- Reimbursement within 14 days of receipt of the return package, directly to the bank card or Paypal account used to pay for the order or in the form of a credit note valid for 6 months.

Important: For the customer benefiting from a gift card or other promotional codes offered, the return of the package will be reimbursed automatically against a credit valid for 6 months.

The terms and conditions may differ during exceptional commercial operations, they will then be stipulated in the details of the commercial operation.

The customer must return the item to us according to the returns procedure set out in the exchanges & Returns section with the validated return slip and a copy of their invoice.

Important: To ensure that your request is processed in the best possible conditions, be sure to complete the Return Form form, providing the requested information as accurately as possible.

Attention :

The return will be processed automatically as a refund (excluding shipping costs).


If delivery costs were offered during a current special offer from a certain amount spent (for example by Mondial RELAY from €69 spent, excluding vouchers, gift cards, promo codes, credit notes) these Fees (€5) are automatically deducted from the refund.


Only
at the buyer's request, a credit note valid for 6 months can be issued for a future order and no delivery costs in this case will be deducted.

Condition to benefit from free shipping costs* by Mondial RELAY is to have spent minimum €69 in the same order (also after possible reimbursement) and by Colissimo la POSTE from €99 spent.

If the customer opts for a credit when exercising the right of withdrawal, he accepts the fact that any new purchase with this voucher will not give rise to a refund but to a credit, valid for 6 months from its issue. In accordance with Papillon Mode's general conditions of sale, for hygiene reasons: lingerie, tights, swimsuits, leggings and earrings will not be returned or exchanged. It will be up to the customer to keep all proof of return, giving a certain date to this shipment. The right of withdrawal is exercised under the same conditions from the time of ordering and before delivery. Items purchased on sale or during exceptional sales (clearance sales, private sales, VIP sales, flash sales) or benefiting from a code or promotional offer will not be eligible for a refund or exchange. nor even an asset.

8. WARRANTY

In the absence of conformity or hidden defect declared by the customer, assessed and proven, www.papillonmode.com will offer the customer repair, replacement of the product or reimbursement subject to the cost conditions provided for by article L217-9 of the code of consumption.

Non-performance or late delivery cannot be attributable to www.papillonmode.com.

Cash on delivery returns are not accepted.

In the event of abnormal or abusive complaints, www.papillonmode.com may refuse to serve a subsequent order.

www.papillonmode.com cannot be held responsible for the misuse and/or intensive use of the articles that the Customer may make of them.

Likewise, www.papillonmode.com cannot be held responsible for the return of a competing product and/or not sold by www.papillonmode.com. It is the customer's responsibility to return the correct item.

9. MEDIATION

In accordance with articles L611-1 et seq. of the Consumer Code, the Customer has the right to have free recourse to a consumer mediator for the amicable resolution of a dispute. The mediation service is free for the consumer.

In the event of a dispute relating to the existence, validity, interpretation, execution or extinction of obligations, the judgment of the Commercial Court in whose jurisdiction the defendant's domicile is located will be submitted.

If, during the mediation process, the Client wishes to be assisted by a lawyer or seek the advice of an expert, the related costs will be their responsibility.

10. RESPONSIBILITY

The liability of www.papillonmode.com cannot be held liable for the non-execution or poor execution of the contract concluded in the event of the occurrence of an event attributable to the customer, of any inconvenience, unforeseeable and insurmountable damage inherent to the use of the network Internet, in particular a service interruption, an external intrusion or the presence of computer viruses, in the event ofshortage of stock, unavailability of the product, in the event of disruption, flood, fire, strike, in particular postal services and means of transport or communication or any other event qualified as force majeure, in accordance with case law.
